ملخص البحث
تواجه إجراءات التقاضي في الواقع العملي الكثير من المصاعب على الصعيد المادي وفي سيوح القضاء، حيث أنها ملازمة لقواعد وليدة العرف القضائي والذي يعتمد على السياق التقليدي في توجيه حق التقاضي، حيث أن تقديم طلبات لغرض تأجيل المرافعة أو الاستعانة بخبير قد تكون محل رفض من قاضي الموضوع، لكون أن هذه الإجراءات يعتقد القاضي أنها تؤخر وتعرقل حسم الدعوى، وبين هذه الاعتقادات وبين سلطة القاضي في توجيه مسيرة الدعوى، نجد أنه لا مناص من إيجاد بديل ينظر بعدد الدعاوى وبكافة أنواعها المدنية، الجزائية، الإدارية وغيرها من أنواع الدعاوى، وأن هذا البديل صحيح أنه من صنع البشر إلا أنه يعمل بشكل مغاير عن من صنعه، ونقصد بذلك تقنية الذكاء الاصطناعي، والذي نهدف من خلال هذا البحث أن تحل هذه التقنية محل البشر في مواجهة إجراءات الدعوى المدنية بدءً من رفع الدعوى والمرافعة والنظر في الدفوع وحتى صدور الحكم دون تدخل البشر من جهة المحكمة، أي أن المتقاضين يقومون برفع دعواهم مع مرفقاتها ويتولى الذكاء الاصطناعي النظر في هذه الدعاوى مع مراعاة جانب العدالة القضائية لأطراف الدعوى المدنية، ومع التركيز على ميزة سرعة ودقة حسم الدعاوى مهما بلغ العدد.
In practice, litigation procedures face numerous difficulties, both logistically and within the judicial system. These procedures are often governed by established judicial custom, which relies on traditional approaches to administering the right to litigation. Requests for adjournment or expert assistance may be rejected by the presiding judge, who may believe these procedures delay and impede the resolution of the case. Caught between these beliefs and the judge’s authority to direct the course of proceedings, an alternative is needed to handle all types of cases—civil, criminal, administrative, and others. While this alternative is indeed human-made, it operates differently from its creators. This alternative is artificial intelligence (AI). The aim of this research is to enable AI to replace human intervention in civil litigation procedures, from filing the lawsuit and pleading to reviewing defenses and issuing a judgment, all without human intervention from the court. In other words, litigants file their cases with supporting documents, and AI handles the review, ensuring fairness for all parties involved, while emphasizing speed and accuracy. Resolving all cases, regardless of their number.
