ملخص البحث
يشكل قطاع النفط والغاز الركيزة الأساسية للاقتصاد السعودي، غير أن أنشطة الاستكشاف والاستغلال تثير العديد من التحديات القانونية المتعلقة بالمسؤولية المدنية والبيئية، إضافة إلى التزامات المملكة بالاتفاقيات الدولية. يهدف هذا البحث إلى تحليل الإطار الدستوري والتنظيمي المنظم لهذه المسؤولية في المملكة العربية السعودية، مع إبراز دور الأنظمة الوطنية مثل النظام الأساسي للحكم ونظام حماية البيئة ونظام التعدين، فضلاً عن دراسة مدى توافق هذه الأنظمة مع المعايير والممارسات الدولية. كما يتناول البحث مسؤوليات الشركات الوطنية والأجنبية، ويستعرض الجهود السعودية في مواءمة تشريعاتها مع التوجهات الدولية في ضوء رؤية 2030. وتخلص الدراسة إلى أن المملكة أرست إطارًا قانونيًا متكاملًا يعزز حماية الموارد الطبيعية ويضمن استدامة التنمية.
The oil and gas sector constitutes the cornerstone of the Saudi economy; however, exploration and exploitation activities raise several legal challenges related to civil and environmental liability, in addition to the Kingdom’s obligations under international agreements. This research aims to analyze the constitutional and regulatory framework governing such liability in the Kingdom of Saudi Arabia, highlighting the role of national laws such as the Basic Law of Governance, the Environmental Protection Law, and the Mining Law. It also examines the extent to which these laws align with international standards and practices. Furthermore, the study explores the responsibilities of national and foreign companies and reviews Saudi efforts to harmonize its legislation with global trends considering Vision 2030. The research concludes that the Kingdom has established an integrated legal framework that enhances the protection of natural resources and ensures sustainable development.
